HOS Exemption Extension Reminder

- The Association would like to remind members that they are exempt from the 30-minute break provision in the current hours-of-service (HOS) rules until the year 2020.

The Department of Transportation (DOT) updated the HOS requirements under the “Fixing America’s Transportation Act” of 2015. However, SC&RA pursued and acquired an exemption for drivers of specialized loads moving in interstate commerce that exceeds normal weight and dimensional limits, aka oversize/overweight (OS/OW) loads.
Details of the exemption include:
  • The exemption is effective 6/18/15 – 6/18/20. (Note – the original exemption expired 6/18/17 but was extended to 6/18/20)
  • The exemption technically only applies to interstate trips; however, according to the Federal Motor Carrier Safety Administration (FMCSA), most states honor federal interstate exemptions for intrastate travel.
  • Drivers are required to carry a copy of the 3-page FMCSA Letter/Federal Register notice.
  • To be eligible, drivers must have a “Satisfactory” safety rating with the FMCSA, have the FMCSA Safety Measurement System (SMS) scores below intervention thresholds, and report any accidents to the FMCSA within five business days of the accident.
  • Drivers are expected to log use of the exemption.
  • The exemption applies at the point in time when the break becomes mandatory, which means even if the haul did not start OS/OW, so long as the load is OS/OW during the break period, the exemption is still applicable.
