SC&RA, COA, and MCOG file Motion for Leave to Participate as Amicus Curiae in Sims Crane Matter

- Pursuant to Commission Rule 74, 29 C.F.R. § 2700.74, the Specialized Carriers & Rigging Association, the Crane Owners Association, and the Mobile Crane Operators Group, jointly and through counsel, have filed a motion to move for leave to participate as amicus curiae in a case where Sims Crane allegedly violated the standard 30 C.F.R. § 56.16009 in that its employees failed to “stay clear of suspended loads.”

According to the motion, “The citation and the judge’s decision upholding the citation are of serious concern to movant associations, because the interpretation of the standard embodied in the citation is contrary to and will interfere with the manner in which the rigging, lifting and moving of heavy and/or large equipment or other materials is safely conducted by crane operators.”

Further, the motion also states, “The interpretation of the standard embodied in the citation at issue in this case would force crane operators at mines to change safety procedures and safety training which have been and are being widely used by crane operators, and are consistent with the regulations and standards applicable in other industries, including the construction industry.”
